Thiruvananthapuram: Aisha Sultana, an island native and director, cannot be charged with treason for speaking out against the Lakshadweep administrator. Lawyer Kaliswaram Raj said that the treason charge against Aisha would not stand.He said the case against Aisha would not stand as per the judgment of the Constitutional Bench in the Kedarnath Singh case of 1962 and the Supreme Court judgment in the case of journalist Vinod Dua.
The Supreme Court has repeatedly stated that only a call aimed at rioting or aggression becomes a crime of treason. There is not a single word in Aisha Sultana’s statement that can be charged with treason, ‘said Kaliswaram Raj.
Aisha has been charged with calling island administrator Praful K Patel a “bio-weapon” in a Media One channel discussion. Kavaratti police have registered a case against Aisha Sultana on a complaint filed by Lakshadweep BJP president Abdul Qadir Haji.
According to Aisha, the central government used Praful Patel’s biofuels against Lakshadweep in the same way that China used the corona virus biofuels against other countries. But the party leaders themselves came out against the island BJP president who had lodged the complaint. Many have left the party. The BJP in Lakshadweep is also tired of the controversy.
